Privacy Statement

Arkansas Blue Cross and Blue Shield respects your right to privacy. This Privacy Statement applies to USAble Mutual Insurance Company, which also does business as Arkansas BlueCross and BlueShield and BlueAdvantage Administrators of Arkansas and Skai Blue Cross and Blue Shield, both of which are third-party administrative services divisions of the company. USAble Mutual Insurance Company also has the following affiliated companies: HMO Partners, Inc., d/b/a Health Advantage; USAble HMO Inc., d/b/a Arkansas Blue Medicare and d/b/a Octave Blue Cross and Blue Shield; and USAble PPO Insurance Company, d/b/a Arkansas Blue Medicare Plus. Throughout this notice, we will use the name “Arkansas Blue Cross” (“we,” “our,” or “us”) as a shorthand reference for the divisions and affiliated companies above. Please note that although we are combining this website Privacy Statement for convenient, shorthand reference, and to make it more efficient to inform you about your privacy rights, Arkansas Blue Cross/BlueAdvantage/Skai Blue is a separate company from Health Advantage, Octave and Arkansas Blue Medicare and each company has their own operations, management and compliance responsibilities.

This Privacy Statement applies to the personal identifying information (which is information related to an identified or identifiable individual also called “PII”) we collect through the website or app from which you accessed this Privacy Statement (the “Site”).

This Privacy Statement does not apply to our practices related to Protected Health Information (PHI) as defined by the Health Insurance Portability and Accountability Act. For details on our practices related to PHI, please refer to our Notice of Privacy Practices.

This Privacy Statement also does not apply to other websites, apps, or online services that we control or maintain that do not link to this Privacy Statement. Please note that we will indicate any changes to this Privacy Statement by revising the “Last Updated” date at the top of the Privacy Statement. Any such changes are effective when we post the revised Privacy Statement on the Site.

  1. Personal Information (PII) We Collect
  2. PII we collect through the Site may include:

    • Contact information, such as first name, last name, date of birth, email address, telephone number, and mailing address
    • Surveys, Community Event, and Customer Service Information and User Content, such as information you provide when you fill out surveys, sign up for certain community events (such as your interests or other information to receive community event gifts or competition prizes), other information you provide when contacting our customer service department, or your views, comments and other communications, pictures, trackback URLs or videos on the Site, which may include discussion boards, blogs and other services that allow users to provide feedback, comment or content (“User Content”)
  3. Cookies and Other Similar Technologies

    We, and our vendors, may use cookies, web beacons, pixels, APIs, and other similar technologies on the Site for various purposes such as to help the Site store your preferences and settings, enable functionalities and features, support Site performance, conduct analytics such as to identify where the Site needs to be fixed, combat fraud, and perform marketing. These technologies may process certain information about your interactions with the Site, across the internet and devices, over time, such as IP address, device ID, browsing and search history, browser types, operating system details, referring URLs, length of visits, traffic data, and your time zone.

    You may be able to manage certain of these technologies by adjusting your browser or device settings. Note that we do not respond to browser Do-Not-Track signals. We are not responsible for any manager or settings tools provided by third parties, including their functionality.

  4. Purposes of Use and Disclosure of Personal Information (PII)

    We collect, use, and disclose (such as to subsidiaries and affiliates, vendors, marketing partners, business partners, and other entities) personal information to:

    • Maintain and improve the Site and our services, including providing you services you request
    • Help you book attendance for community events and customer service appointments
    • Communicate with you, including in relation to community events, customer service inquiries, or marketing emails
    • Market and promote our service, including on other platforms we do not control
    • Conduct internal analyses, such as surveys, studies, market research, monitoring or analyzing trends, usage and activities
    • Detect and prevent fraud, enforce our legal rights, comply with certain obligations under applicable laws, regulations, and legal processes, as well as establish or exercise our legal rights, for fraud or crime-prevention purposes, or for the protection of the rights, property, or safety of our company or third parties
    • Otherwise process your personal information at your direction

    Additionally, we may disclose personal information as part of a prospective or actual corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of our business or assets.

  5. Sweepstakes, Contests, and Promotions

    We may use your PII to send you to conduct surveys, contests, sweepstakes, and to award prizes. We may request additional information to participate in contests and surveys (such as your photos, personal opinions, preferences, and interests). Participation in these promotions is completely voluntary and you may choose whether or not to participate. Contact information will be used to notify the winners and award prizes. Your PII may be disclosed to third parties or the public in connection with the administration of a promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the promotion’s official rules, such as on a winner’s list. Such promotions may be subject to separate terms that describe further how PII may be used. Please refer to each promotion’s terms for such details.

  6. Your Choices

    By adding User Content to the Site or to one of Arkansas Blue Cross's social media sites, users understand and acknowledge that this information may be available to the public and grant Arkansas Blue Cross a nonexclusive license to display, reproduce, transmit, modify such User Content, and the right to use it for internal and external marketing purposes. Please note that other users may access and distribute posted information beyond the control of Arkansas Blue Cross. Individuals who do not wish to have their User Content used, published, copied and/or reprinted, should not post on these Sites.

    To opt-out of marketing emails, you may use the opt-out method described in those marketing emails. You may not be able to opt-out of receiving certain electronic communications from us, such as transactional communications or legal notices.     California residents may request certain information about certain types of personal information we disclose to third-parties for the third-parties’ direct marketing purposes. To submit this type of request, email us using the contact information below with “California Shine the Light Request” as part of the subject line. The information we provide and our response is subject to applicable law.

  7. Links and Interactive Features

    The Site contains links to other websites and online services and interactive features provided by third-parties that are not maintained or controlled by Arkansas Blue Cross. For example, we may embed certain features that allow you to watch videos, book customer service appointments, add community events to your external calendar, or share Site content on your social media profile or page. Our vendors may process the information obtained through the features on the Site to provide services on our behalf. Your use of the interactive features on the Site is voluntary. We have no control over and are not responsible for services provided by third-parties and this Privacy Statement does not apply to websites and online services not controlled or maintained by us.

  8. Data Security

    We maintain reasonable and adequate technical, administrative, and physical security and confidentiality measures designed to help protect your PII from unauthorized access or acquisition. Confidentiality of information transmitted via this Site or over the internet cannot be guaranteed to be completely secure.

  9. International Visitors to the Site

    If you are located outside of the United States, by using the Site you acknowledge that we collect, process, and store PII in the United States. You also acknowledge that the data protection and privacy laws in the United States may not offer the same level of protection as the applicable laws in your location.

  10. Centers for Medicare and Medicaid Services – Collection of PII in the Federally-facilitated Market Place

    The Centers for Medicare & Medicaid Services (“CMS”), requires that prior to collecting PII for enrollment purposes, we must provide a Privacy Notice Statement that is prominently and conspicuously displayed on a public-facing website.
